CLICK HERE to view the information. Court Finds State Pension Reform UnconstitutionalA court’s Nov. 21 decision threw out the state’s gutless attempt to diminish and impair public employee pension benefits.
The Seventh Judicial Circuit Court for Sangamon County announced that the state’s pension reform law, which passed as Senate Bill 1 in December 2013, is in fact unconstitutional. The State Court ruled against the entire law, noting that the 39 separate changes to the pension code were so corrupt constitutionally, the entire law is considered void. The ruling states “…It is clear that if something qualifies as a benefit of the enforceable contractual relationship resulting from the membership in one of the State’s pension or retirement systems, it cannot be diminished or impaired. The Illinois legislature could not have been more clear that any attempt to diminish or impair pension rights is unconstitutional.” Setting the timeline Teamsters Local 700 President Becky Strzechowski testified in Springfield last December and cited how damaging the proposed pension reform bill would be to public employees. On Dec. 3, 2013, Illinois lawmakers passed SB1 by a narrow margin to reduce state debt on the backs of public employees. On Jan. 28, 2014, Teamsters Local 700 together with Teamsters Joint Council 25 and the We Are One Illinois Coalition filed a lawsuit rightfully claiming the bill’s unconstitutionality. On May 12, 2014, the We Are One Illinois Coalition filed for injunctive relief so the unconstitutional pension reform law would not take affect until a decision was reached on the pending lawsuit. Rob Fierstein, Chief Steward of the Illinois State Police Master Sergeants, will be the first Teamster to ever serve as Trustee of the State Employee Retirement System (SERS), securing victory in a landmark election on June 6.
A member of Teamsters Local 700, Fierstein officially begins a five-year term with SERS beginning July 15. The 13-member board consists of four elected trustees, two state employee retirees, six appointees designated by Gov. Pat Quinn and the Illinois Comptroller, who serves as chairman. The full committee reviews disputed benefits, administers policy and approves legislative initiatives concerning Illinois’ pension system for tens of thousands of active and retired state workers. “This election shows the strength of the Teamsters across the state, and I’m extremely motivated to bring a voice to my public employee brothers and sisters in this new role,” said Fierstein. Fierstein’s career in public service began more than 25 years ago when he became a trooper with the State Police. As Local 700’s Chief Steward of the Master Sergeants, he works closely with state departments to help the Teamsters secure strong contracts for law enforcement. It’s experience Fierstein said will pay dividends in his role as SERS Trustee. “I’ve been fortunate to work in many districts throughout my career and I’ve seen the same challenges facing public employees across the state. There’s no doubt that the biggest challenge to those of us in law enforcement and in the public sector is the threat to our retirement security,” Fierstein said. The Chief Steward is no stranger to fighting for public workers. Prior to the careless passage of Senate Bill 1 — which currently compromises the retirement benefits of state employees and is being challenged in court by Local 700 and the We Are One labor coalition — Fierstein spent time in Springfield lobbying to protect benefits with his fellow Teamsters. “We are so proud to have a Teamster member and a Local 700 Chief Steward elected to serve as a real voice for labor on the SERS Board,” said Becky Strzechowski, President of Teamsters Local 700 and a Teamsters Central Region International Vice President. Four candidates ran for three seats on the board this year. Fierstein secured election with nearly 60 percent of support from voting state employees. Benevolent Fund Applications Now Available!
